About This Recipe

Matters that entrepreneurs may be too busy to pay attention to, are the very issues that can morph into legal headaches. Examples are terms and conditions that are not well thought through, the lack of a complaints policy or inappropriate IP protection.

Attorney Nicolene Schoeman-Louw, herself an entrepreneur, advises business owners to approach most decisions - from how to choose their legal advisor to trademarking (or not) their logo - in the context of their business vision and mission.

She explains her recommended top-down approach to contracting, and the different expectations employers and employees have of a probation period.

What You'll Learn

You will learn that legal problems can be symptomatic of process problems, such as late payments that are not followed up timeously, and probation employees whose performance is not managed properly.

Further useful information includes what an NDA can tell you about a prospective client or partner, and why not every new idea you have deserves IP registration and protection.

The thinking behind Ts and Cs is unpacked, along with some insight into the purpose of the CCMA and the three grounds on which an employment relationship can be terminated in South Africa.
